AUTODIALER LAW DOES NOT APPLY...22 Feb 2008
Washington, D.C. - FreeEats.com today announced its pleasure with the ruling handed down by Indiana Judge Larry Blanton (Orange County Circuit Court) which held that Indiana's Autodialer Law does not apply to prerecorded political messages and that the State may not sanction political speakers for making these calls.
"This ruling adds significant weight to the case law currently building in courts across this country which state that free speech in America, particularly the most effective form of political speech today, automated calls, cannot be prohibited, as some law enforcement officials have threatened," said Gabriel Joseph, President of Free.Eats.com.
This is the second setback in a six-month time period for Indiana's Attorney General in his campaign to get a court to prohibit political speech. FreeEats.com will use Judge Blanton's ruling in defending itself against a similar lawsuit by the Indiana Attorney General.
FreeEats.com believes that the Indiana Autodialer Law and laws similar to it which try to absolutely prohibit automated calls are an outright violation of the free speech rights of political speakers, voters, and the company under both the U.S. and Indiana constitutions. FreeEats.com also believes that the laws are unconstitutional because they have been preempted by a rule issued by the Federal Communications Commission that expressly authorizes interstate prerecorded political calls.
FreeEats.com and similar companies have been active in the 2008 presidential primaries, and FreeEats.com will seek court approval in order to allow Indiana citizens to participate in this important political dialogue in advance of the May 6th Indiana primaries.
